Terms and Conditions for Tabres

1. Acceptance of Terms

Welcome to Tabres ("we," "our," or "us"). By accessing or using our comprehensive digital ecosystem designed for restaurants, cafés, pubs, and hotels, you ("User," "Merchant," or "you") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use our platform or services.

2. Description of Service

Tabres provides a hospitality management platform that includes, but is not limited to:

Point of Sale (POS) systems.
QR Menu, Table, Delivery, and Takeaway ordering systems.
Kitchen Display Systems (KDS).
Digital menus with Link-in-Bio and AI translation capabilities.
Inventory management, staff administration, and AI-powered menu analytics.

3. Account Registration and Eligibility

Our services are intended for business-to-business (B2B) use by commercial entities (Restaurants, Bakeries, Coffee Shops, Bars, Pubs, Nightclubs, and Hotels). By registering for an account, you represent that you have the legal authority to bind your business entity to these Terms. You must provide accurate and complete information during registration and keep your account credentials secure.

4. Pricing and Fees

Platform Access: Tabres is entirely free to use, requiring no credit card for access to our core features, with no hidden fees.
Payment Processing: If you choose to use our optional payment platform, we will charge a small transaction fee. The specific rates for these optional services will be provided to you upon activation of the payment gateway.

5. Privacy and Data Processing

We respect your privacy and are fully committed to GDPR (EU and UK) compliance, as well as applicable US privacy laws (such as the CCPA).

Data Processing Agreement (DPA): When you use Tabres to process customer orders, you are the Data Controller and Tabres acts as your Data Processor.
Tracking and Cookies: Tabres does not use cookies. We do not sell your personal data.
Analytics and Security: We use self-hosted Plausible for analytics and self-hosted logging solutions for error tracking to ensure user privacy. We utilize Cloudflare for CDN and security.
Advertising: If we run Meta ads, a Meta Pixel may be temporarily active to track ad effectiveness, but it is strictly turned off when campaigns end and does not track user behavior on our site natively.
Data Residency: All servers are located in Europe, and we utilize AWS S3 in Europe for file storage.

6. Intellectual Property

Tabres IP: We retain all rights, title, and interest in and to the Tabres platform, including its software, AI tools, and digital infrastructure.
User Content: You retain full ownership of all digital menu content, product videos, and branding you upload to the platform. You grant Tabres a non-exclusive license to host and display this content solely to provide the services to you.

7. Acceptable Use

You agree not to use Tabres for any unlawful purpose. You are solely responsible for ensuring that the items you sell, the information you display, and your delivery logistics comply with all local, state, federal, and international laws, including food safety and consumer protection regulations.

8. Warranties and Limitation of Liability

As-Is Basis: While we provide premium support and cloud-based reliability, the platform is provided on an "as-is" and "as-available" basis.
Liability Cap: To the maximum extent permitted by applicable US, UK, and EU law, Tabres shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising from your use of the platform.

9. Termination

You may terminate your account at any time. We reserve the right to suspend or terminate your access to Tabres if you violate these Terms or engage in fraudulent or illegal activities. Upon termination, your right to use the platform ceases immediately.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the competent courts in the Netherlands, acknowledging applicable consumer and business rights under EU, UK, and US law where legally mandated.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via the email address associated with your account or through a notification on the platform dashboard. Your continued use of Tabres after such modifications constitutes your acceptance of the updated Terms.
